Terms of Service

1. Agreement to Terms

By accessing or using Paint n Sip Designs ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms form a binding legal agreement between you and Paint n Sip Designs.

2. Description of Service

Paint n Sip Designs provides a membership-based library of painting designs, instructional videos, PDF guides and marketing assets for use by paint-and-sip event businesses. Access is granted on a subscription basis, either monthly or yearly.

3. Membership & Billing

Membership fees are charged in advance on a recurring basis. Monthly memberships are billed every 30 days. Yearly memberships are billed every 12 months. All prices are in USD and exclude any applicable taxes. You authorise us to charge your chosen payment method for all fees incurred.

If payment fails, we may suspend your access until the outstanding amount is settled. You may cancel your monthly membership at any time through your account settings. Cancellations take effect at the end of the current billing period.

4. License & Permitted Use

While your membership is active, you are granted a limited, non-exclusive, non-transferable license to use the designs and assets solely for hosting in-person paint-and-sip events at your own venues or on behalf of your business. You may use included marketing materials (posters, banners, thumbnails) to promote those specific events.

All intellectual property rights in the designs remain with Paint n Sip Designs. You receive a usage license only — not ownership of the designs.

5. Restrictions

You may not:

• Use designs for online or virtual events.
• Produce physical products including paint kits, mugs, apparel, hats or any other merchandise using the designs.
• Resell, sublicense, redistribute or share the designs with third parties.
• Claim authorship or ownership of the designs.
• Use the materials to train AI models or generate derivative works through automated systems.
• Continue using the materials after your membership ends, including for events that have been promoted but not yet taken place.

6. Termination

Your license terminates automatically when your membership lapses or is cancelled. All rights are revoked immediately upon termination, even if an event is in the process of being promoted. You must time the end of your membership so it falls after any event using the materials has actually taken place.

We reserve the right to suspend or terminate your account immediately for violations of these terms, fraudulent activity, or conduct that harms the Service or other users.

7. Post-Cancellation Compliance & Enforcement

When your membership is cancelled or lapses, your account details remain on our system for compliance and enforcement purposes. We conduct regular checks to verify that our designs and assets are no longer being used by former members.

If we discover that you continue to use our designs or marketing materials after your membership has ended — whether for events, promotions, merchandise, or any other purpose — this constitutes a breach of these Terms and of our License Agreement. We reserve the right to take formal legal action, including but not limited to seeking damages and injunctive relief, to protect our intellectual property and ensure our designs are not used without an active membership.

8. Refund Policy

Yearly memberships are non-refundable except where required by law. If you cancel a yearly membership, you retain access until the end of the paid 12-month period. Monthly memberships can be cancelled anytime with no further charges; no partial-month refunds are provided.

9. Limitation of Liability

To the fullest extent permitted by law, Paint n Sip Designs shall not be liable for any indirect, incidental, special or consequential damages arising out of or in connection with your use of the Service. Our total liability shall not exceed the amount you paid for membership in the 12 months preceding the claim.

We are not responsible for how accurately you replicate our designs, how effectively you distribute your marketing materials, or the level of sales or bookings you achieve. Success depends on many factors outside our control, including your own execution, venue, location and audience.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance of the revised Terms.
